1. Acceptance of terms

These Terms of Use govern your access to and use of conquestpestservices.com (the “Site”), operated by Conquest Pest Control, also operating as Conquest Pest Services, a DBA of Pittalia & Brothers LLC (“Conquest,” “we,” “us,” or “our”).

You accept these Terms of Use by submitting a form on the Site — a quote request, a contact request, or an estimate request. A notice next to the submit button on each form states that submitting it means you agree to these Terms of Use and our Privacy Policy. If you do not agree to these terms, do not submit a form.

The Site is intended for adults. By submitting a form, you represent that you are at least 18 years old and are able to enter into this agreement.

2. What this website is

The Site provides information about pest control services offered by Conquest in the Greater Houston, Texas area, and lets you request a quote, contact us, or request an estimate. Using the Site or submitting a form does not, by itself, create a contract for pest control services. Any actual service is governed by a separate service agreement provided to you at the time you schedule service, which will include specific terms such as warranty coverage, scheduling, and cancellation.

How we collect, use, and share the information you submit — including cookies, analytics, and advertising technologies — is described in our Privacy Policy, which is incorporated into these terms by reference.

3. Intellectual property

The Site and its content — including text, graphics, logos, images, and the Conquest name and branding — are owned by Conquest or our licensors and are protected by copyright, trademark, and other laws. You may view and print pages from the Site for your own personal, non-commercial use, but you may not reproduce, distribute, modify, or create derivative works from the Site’s content without our prior written permission.

4. Acceptable use

When using the Site, you agree not to:

• Submit false, misleading, or fraudulent information through our forms.
• Use automated tools to scrape, copy, or extract content from the Site.
• Attempt to interfere with, disrupt, or gain unauthorized access to the Site or its underlying systems.
• Use the Site’s contact or estimate forms to send spam, unsolicited advertising, or unrelated commercial content.
• Use the Site for any unlawful purpose.

If we believe you have violated these restrictions, we may suspend or terminate your access to the Site, block form submissions from you, decline to provide services, and pursue any legal remedies available to us, including injunctive relief. We may also report suspected unlawful activity to law enforcement. We may take these steps without notice.

5. Third-party links & embeds

The Site links to, or embeds tools from, third parties — including our estimate-request form (Typeform), our customer portal (GorillaDesk), Google Maps, and our social media pages. We don’t control these third-party sites and services and aren’t responsible for their content, privacy practices, or terms. Your use of them is governed by their own terms and policies.

6. No warranty

The Site and its content are provided “as is” and “as available,” without warranties of any kind, express or implied. We try to keep information on the Site accurate and current, but we don’t guarantee that pricing, service area, or availability information is error-free or up to date at all times. Nothing on the Site is a guarantee of pest control results — actual outcomes depend on an inspection and the terms of your service agreement.

7. Limitation of liability

To the fullest extent permitted by law, Conquest will not be liable for any indirect, incidental, special, or consequential damages arising from your use of, or inability to use, the Site, even if we’ve been advised of the possibility of such damages. To the fullest extent permitted by law, our total liability for all claims relating to the Site or these Terms of Use will not exceed one hundred dollars ($100).

This limitation applies only to the Site. It does not apply to liability arising from pest control services performed under a separate service agreement, which is governed by that agreement’s own terms, and it does not limit any liability that cannot be limited under Texas law.

8. Indemnification

You agree to indemnify and hold Conquest harmless from any claims, damages, or expenses (including reasonable attorneys’ fees) arising from your misuse of the Site or your violation of these Terms of Use.

9. Arbitration & class action waiver

Please read this section carefully. It affects your legal rights, including your right to go to court and to participate in a class action.

This section applies only to disputes about the Site or these Terms of Use — not to pest control services, which are governed by a separate service agreement with its own dispute-resolution terms.

(a) Agreement to arbitrate. Except for the small-claims option in (h) below, you and Conquest agree that any dispute, claim, or controversy arising out of or relating to your use of the Site or these Terms of Use will be resolved by binding, individual arbitration rather than in court.

(b) Informal resolution first. Before filing an arbitration, you and Conquest agree to first contact the other and try in good faith to resolve the dispute informally for at least 30 days. Send notice to the address in Section 13.

(c) Arbitration rules and provider. Arbitration is administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules (available at adr.org). If those rules conflict with this section, this section controls.

(d) Location. Any in-person hearing will be held in Fort Bend County, Texas, unless you and Conquest agree to a different location or to proceed by video conference or written submissions.

(e) Fees. Conquest will pay all AAA filing and administrative fees and arbitrator compensation for your claim, other than the capped consumer filing fee set by the AAA’s Consumer Arbitration Rules (a fee waiver is available if you can’t afford it).

(f) Who decides what. The arbitrator, not a court, decides disputes about the interpretation, applicability, enforceability, or formation of this arbitration agreement — except that a court, not the arbitrator, decides whether the class action waiver in (g) applies to a given claim.

(g) Class action waiver. You and Conquest may each bring claims against the other only in an individual capacity, not as a plaintiff or class member in any class, collective, or representative proceeding, and not on behalf of any other person. The arbitrator may not consolidate more than one person’s claims. If this waiver is found unenforceable as to a particular claim, that claim (and only that claim) must be brought in court, and the rest of this arbitration agreement still governs everything else.

(h) Small claims exception. Either party may instead bring a qualifying individual claim in small claims court.

(i) 30-day opt-out. You may opt out of this entire arbitration agreement by sending written notice to [email protected] within 30 days of the date you first agreed to these Terms of Use, including your name and a statement that you opt out of arbitration. The rest of these Terms of Use, including the class action waiver, still applies if you opt out; any dispute will instead be resolved in the courts named in Section 10.

(j) Governing law for this section. This arbitration agreement is governed by the Federal Arbitration Act, not by any state law limiting arbitration.

10. Governing law

Apart from Section 9 above, these terms are governed by the laws of the State of Texas, without regard to conflict-of-law principles. Any dispute not subject to arbitration will be brought in the state or federal courts located in Fort Bend County, Texas.

11. Changes to these terms

We may update these Terms of Use from time to time. Changes are effective when posted, shown by the “Last updated” date at the top of this page. Your continued use of the Site after changes are posted means you accept the updated terms.

12. General

Severability. If any provision of these terms is found unenforceable, that provision will be limited or removed to the minimum extent necessary, and the remaining provisions will stay in full effect.

Entire agreement. These Terms of Use, together with our Privacy Policy, are the entire agreement between you and Conquest regarding your use of the Site, and replace any prior understanding about the Site. They do not replace or modify any separate service agreement you sign with us.

No waiver. If we don’t enforce a provision of these terms, that isn’t a waiver of our right to enforce it later.

Assignment. You may not assign or transfer your rights under these terms. We may assign ours in connection with a merger, acquisition, or sale of the business.

No third-party beneficiaries. These terms don’t create rights for anyone other than you and Conquest.
